(a) the terms of the commitment agreement as amended by the agreement; and if a tripartite agreement previously applied to the teacher`s employment at the school and the teacher received an additional retirement pension under this Agreement in lieu of long-term leave and annual leave, the teacher`s entitlement to long-term leave will be adjusted accordingly, notwithstanding the provisions of paragraph 12.5(c) of this Agreement. (v) The right of a part-time teacher to sick leave is proportional to the number of teaching hours of that teacher during a full school week in relation to the number of lessons that a full-time teacher is normally required to teach in school. (ii) The school shall examine the application taking into account the situation of the teacher and, if the application is indeed based on the teacher`s parental responsibility, may reject the application only on valid grounds relating to the impact on the workplace or the functioning of the school. These reasons may include cost, lack of adequate replacement staff, loss of efficiency, and impact on customer service. (v) Notwithstanding paragraph 12.3(a), a part-time teacher is entitled only to breastfeeding leave equal to the teaching hours of a part-time teacher for lessons that a full-time teacher is normally required to teach in the school. Where excessive payments are made in circumstances which were not obvious or could not reasonably be expected to be determined by the teacher, the parties concerned shall endeavour to reach agreement on the issue of overpayment, including, where appropriate, a discussion between the teacher`s representative and the relevant school representatives. (i) Sick leave accrued under this Agreement shall include sick leave taken after 1 January 2011 and, in the case of teachers employed at the time of entry into force of this Agreement, sick leave accrued before 1 January 2011. Teachers employed in preschool and early childhood services (a) The salary to be paid to any teacher who is not an occasional teacher under this clause shall be paid fourteen days or monthly if it is made by mutual agreement and provided that payment is made two weeks in advance. (ii) If the leave without pay begins on the day following the last day of instruction of a semester and ends on the eve of the first day of instruction of a semester of the same year, a payment shall be calculated and made: the school shall provide, by appointment, to a teacher [other than an occasional teacher] a letter of appointment indicating, inter alia, the ranking and the amount of the salary at the time of appointment; the normal teaching load that will be required, the requirements for performing extracurricular tasks and an overview of the pension benefits available to teachers in the school.

(ii) where the departments of primary and secondary education are located in different locations and support for staff and curricula is carried out separately, if the number of enrolments in a department exceeds 200. d) The school must inform the teacher in writing of the value of the service before the conclusion of the contract. One. Employers listed in Annex E – Employers and schools covered by this Agreement with respect to the schools listed in the Annex; and (v) sick leave accrued before 1 January 2011, including sick leave of up to 20 days at full pay and 20 days at half pay per year of service, shall be retained by the teacher and may be taken in accordance with the provisions of the agreement or supplement on the basis of which he or she was born. In particular, a teacher is entitled to accrued sick leave only for the four years of uninterrupted service that begin immediately with the current year of service. However, if the cumulative sick days are converted into half of the days for a full salary at half the salary. (iv) When defining a field of instruction, the school may combine two or more subjects into a single subject, provided that the total number of hours of aggregated instruction in an educational area comprising more than one subject cannot exceed 4,000 hours of instruction per year. Teachers employed immediately prior to the date of completion of this Agreement shall be deemed to be classified and paid under this Agreement at a level at least below the level applicable to the Teacher under any prior assignment or agreement and shall be deemed to be years of service at the time of signing this Agreement, calculated in accordance with the provisions of the previous award or agreement.

(b) The school and the occasional teacher shall agree on the period during which the teacher has the right not to be available to participate in the work. In the absence of an agreement, the teacher has the right not to be available to participate in the work for up to 48 hours (i.e. two days) per occasion. The occasional teacher is not entitled to a payment for the period of non-participation. .
